‘It was only by chance that I came across the services of Cheselden Continuing Care in a weekend newspaper. In common, I suspect with the majority of the population I believed that care costs were not recoverable. A short telephone conversation enlightened me that this was not necessarily true.

So began something of a saga, and for Cheselden staff a great deal of hard work and dedication. ‘Our late mother was suffering from dementia and related physical illnesses when she died in a nursing home in the North West of England in 2008, aged 76. To cover the cost of her fees – which rose to as much as £2,240 every four weeks – we had been forced to sell her bungalow and over 17 months, paid tens of thousands of pounds for her care.

From the first day she was admitted, the authorities told us that she would need to pay the full nursing home fees. But after making contact with Cheselden, we found we could successfully challenge this. Cheselden painstakingly acquired and assessed all our mother’s medical records and other relevant papers and I am delighted to say that the Primary Care Trust finally agreed that her care should have been state funded. We were reimbursed all her fees – more than £40,000 in total.

‘When my mother died in a nursing home just four months before her 100th birthday, the family had paid out more than £60,000 to cover the cost of her care. We were always led to believe that we had to find the £2,000 a month fee, and after she died we were brainwashed into believing that we couldn’t recover the fees. We even had to sell my mother’s bungalow to help pay the costs.

When we contacted Cheselden, after a detailed medical assessment they told us we had a strong case for claiming the monies back because my mother’s medical condition meant the NHS should have funded her care. My mother was registered blind, had arthritis, was incontinent, had hallucinations, could not feed herself, became totally bedridden and could only be bathed using a hoist. The care home had also to call out a doctor to see her on 35 separate occasions.

Cheselden took on our case and finally, the PCT conceded that she should have been entitled to NHS continuing care funding. Thanks to Cheselden, we received a cash settlement covering 75% of the care home fees we’d paid – around £45,000. ‘We enlisted Cheselden’s help with reclaiming my mother’s care home fees because we firmly believed that these costs should have been met by the NHS – and we were right! In the months before she died, my mother was suffering from Parkinson’s disease, had breast cancer, severe arthritis, osteoporosis, was unable to lift herself or walk, could not manage her own medication and was often mentally confused. She was seriously ill, but the PCT still didn’t feel she was ill enough for state funding.

To pay for her nursing care – which varied from around £500 to £850 a week – my mother had to use her life savings and we had to sell her former retirement home. Her care costs swallowed up a very large sum of money and in time, it would no doubt have run out altogether and we would then have had to bear the cost of her care ourselves.

When we approached Cheselden, they looked at her medical records and reports and told us we had a good chance of succeeding with a claim. After two rounds of negotiations, the PCT agreed to refund some of the monies we’d paid for my mother’s care. Cheselden did a wonderful job for us and we have no doubt that we would not have succeeded if we had decided to take on the PCT on our own. Like many people who pursue these claims themselves, we would probably have been worn down by the system and run out of steam.’
