The Claims Process

You or a family member starts the claims process by contacting Cheselden by telephone, post or e-mail. We want to make the process as quick and easy for you as possible. All you need to do is provide us with as much information as possible about your care history and Cheselden will deal with everything else.

First, we carry out a free consultation to determine if you have a potential case for current or retrospective funding. We will ask you to complete a simple questionnaire about your current or previous care situation. You can complete the questionnaire and submit it to us on-line by clicking here. We will treat all the information that you give us in confidence and will not share it with a third party (except for a solicitor appointed to your case) without your express permission.

Having reviewed the information provided, if we consider that you are eligible for current or retrospective funding, we will approach your Primary Care Trust (PCT) to ask them to reconsider your case. If the PCT does not co-operate, your case may end up in court although we will try our best to achieve settlement out of court.

Cheselden’s claims process aims to achieve some or all of the following on your behalf:

  • Ongoing continuing care funding
  • Repayment of continuing care costs that have been wrongly paid, plus back-dated interest
  • Compensation for damages / negligence / maladministration where appropriate.

Please note that if we decide to progress your case, we will need access to detailed information about your medical history, including your medical records. You must give consent to enable us to obtain this information. It is therefore essential that if you do not have the capacity to consent, a representative is appointed who has the legal authority (e.g. Power of Attorney) to give consent on your behalf.

If after reviewing your case, we decide that you do not qualify for current or retrospective funding, the claims process will stop. We will tell you about this straightaway and will let you know what steps you can take to minimise the costs if you are still paying for care.
